As per the Constitution and the Representation of the People Act, 1951, any person can contest an election from any constituency, provided he is qualified to contest an election from that constituency i.e. he is not disqualified under the constitution or other laws for contesting election Have been appointed.
The nomination paper should be handed over by the candidate or any of his proposers to the Returning Officer or the Assistant Returning Officer specified in the public notice of the election.
The candidate is required to reach his/her nomination papers on or before the last date for filing nominations fixed by the Election Commission of India. 30A of the Representation of the People Act, 1951 clarifies that if the last date for filing nominations is the seventh day after the date of notification or if that day is a public holiday under the Negotiable Instruments Act, the nomination papers shall be filed immediately after the public holiday. Submission is required on the next day, which is not a public holiday.
